Law Draft “On state guarantees of enforcement of courts decisions”

On September 15, 2009 in the case “Ivanov v. Ukraine” (application № 40450/04), European Court of Human Rights found violations by Ukraine of Article 6 of the European Convention on Human Rights in implementing the decisions of national courts.

The Court ordered to Ukraine to immediately implement effective remedy, which will be able to provide adequate compensation for failure or delay in implementing the decisions of national courts in accordance with the principles established by the Court.

Following to the court decision, the Cabinet of Ministers of Ukraine developed and submitted to the Parliament of Ukraine the Law Draft “On state guarantees of enforcement of courts decisions”. (Ukrainian version can be found here....)

On September 9, 2011 the Parliament of Ukraine adopted an Act “On adoption as the base of the Law Draft “On state guarantees of enforcement of courts decisions”. Paragraph 2 of the decree instructed the Parliament’s Committee of Justice to finalize the draft and submit it to the Parliament of Ukraine for the second reading.
